Terms and Conditions for Inquiries and Service Requests

Thank you for reaching out to Ellis Wellness for therapy or corporate consultation services. Before submitting your inquiry or requesting our services, please review the following terms and conditions. By submitting an inquiry, you agree to these terms. 

1. Privacy and Data Protection 

Personal Information: When you submit an inquiry, we may collect personal information such as your name, business names and email address, phone number, and health-related information. We are committed to protecting your privacy and will only use your personal and business data in accordance with our privacy policy. 

Data Sharing: Your personal data will not be shared with third parties, except when necessary to provide the requested services or as required by law. We may share your information with therapists or healthcare providers involved in your care, with you consent. 

Cookies: Our website may use cookies to improve user experience. For more details on how we use cookies, please refer to our privacy policy. 

2. Use of Information 

Purpose: Your submitted inquiry will only be used to respond to your request for therapy or corporate consultation services. We may follow up with additional questions or clarifications regarding your needs. 

Consent: By submitting your inquiry, you consent to being contacted by Ellis Wellness for the purpose of providing the requested therapy or corporate services or for administrative purposes related to your request. 

3. Response Time and Availability 

No Guarantee of Response: While we strive to respond to all inquiries promptly, we cannot guarantee a response or specific time frame for a response. Response times may vary depending on therapist availability and demand. 

Service Availability: Our services are available via telehealth across Australia and in-person (Sydney only) , but availability may be subject to location, therapist availability, and scheduling constraints. We may not be able to accommodate every request. 

4. Intellectual Property 

Content Ownership: If you provide any content (e.g., assessments, questionnaires, or other documents) as part of your inquiry, you retain ownership of your content. However, you grant us permission to use the information as necessary to assess and provide the requested services. 

No Unauthorized Use: You may not copy, use, or distribute any content on our website or related to our services without our prior written consent. 

5. Accuracy of Information 

Responsibility for Accuracy: You are responsible for ensuring that the information you provide is accurate and up-to-date. Inaccurate information may affect our ability to respond to your inquiry or provide the appropriate services. 

Changes: If your personal or business information or circumstances change after submitting your inquiry, please notify us promptly so we can update your records and ensure accurate service provision. 

6. Limitation of Liability 

No Liability for Errors: While we take every reasonable effort to provide accurate and effective therapy and corporate services, we are not responsible for any errors, omissions, or delays in responding to inquiries. Our liability is limited to the value of the therapy and corporate services provided. 

Services Provided “As-Is”: Therapy services, including both telehealth and in-person sessions, are provided on an “as-is” basis without any warranty or guarantee of success. We do not guarantee specific outcomes for therapy or corporate services. 

7. Communication Preferences 

Marketing and Follow-Up: By submitting your inquiry, you consent to receive follow-up communications from us related to your inquiry and therapy services. You may also receive information about our services and promotions. You can opt-out of marketing communications at any time. 

8. Payment and Fees 

Cost Estimates: Upon receiving your inquiry, we may provide an estimate for the therapy services requested. The final cost may vary depending on the specific services provided. 

Payment Terms: Payment for therapy services is due upon receipt of an invoice. Payment options and any applicable payment plans will be provided at the time of scheduling your session. Cancellations must be made 7 days (individual services) or 10 business days (for corporate services) in advance to avoid a cancellation fee. 

9. Governing Law and Dispute Resolution 

Jurisdiction: These terms and conditions are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising from these terms or your inquiry will be subject to the exclusive jurisdiction of the courts located in New South Wales. 

Dispute Resolution: In the event of a dispute, we encourage you to contact us directly in an attempt to resolve the matter amicably. If the issue cannot be resolved informally, you agree to engage in mediation as the first step before pursuing any formal legal action. Mediation will be conducted by an independent mediator, and the costs of mediation will be shared equally by both parties unless otherwise agreed. 

If mediation is unsuccessful, the dispute may be referred to arbitration in accordance with the Commercial Arbitration Act 2010 (NSW). Any resulting arbitration will be conducted in Sydney, New South Wales

You agree that, before taking any legal action, you will first seek to resolve any issues through these alternative dispute resolution procedures.  

10. Modification of Terms 

We reserve the right to modify these terms and conditions at any time. Any changes will be posted on our website, and the updated terms will take effect immediately upon posting. It is your responsibility to review these terms periodically. 

11. Third-Party Services 

We may collaborate with third-party providers to deliver certain therapy and corporate services (e.g., specialized services, training or referrals). While we aim to ensure high-quality care, we are not responsible for the actions of these third parties.
